Denver City Code Sentencing Reform

Sentencing in the Denver Municipal or Denver City Court will change.  Formerly, the Denver Revised Municipal Code (DRMC) provided for a one year and/or a thousand dollar fine to be assessed for each violation of the DRMC.  For example, a violation or conviction for Domestic Violence Assault could lead to a one year jail sentence while a violation of Disturbing the Peace (loud stereo) could also be punished by a one year jail sentence.  Clearly, there is a difference in severity between a domestic violence physical assault and a loud stereo and going forward the City of Denver will recognize the difference.

This change came about based on the fact that any type of jail sentence one year or more could have potential immigration issues.  Thus the Denver City Council recognized that a one year jail sentence is not appropriate in every case and as a general rule of thumb we should not treat a Domestic Violence Physical Assault the same as a loud stereo or curfew violation.
